By using MapCenter2 you agree to the following

0. Definitions

IN THESE TERMS AND CONDITIONS “MAPCENTER2” REFERS TO THE WHOLE MAPCENTER2'S WEB SERVICE AND OTHER SERVICES PROVIDED BY MAPCENTER2 AND ITS STAFF.

“USER” REFERS TO ANY USER WHICH DOWNLOADS DATA AVAILABLE AT MAPCENTER2.

“AUTHOR” REFERS TO ANY REGISTERED USER WHO UPLOADS HIS OR HER DATA TO MAPCENTER2.

“MAP” REFERS TO ANY MAP UPLOADED AND AVAILABLE FOR DOWNLOAD FROM MAPCENTER2.

“POLISH FORMAT” REFERS TO DATA FORMAT ACCEPTED BY CGPSMAPPER PROGRAM.

1. Acceptance of terms

By using MapCenter2 you accept the Terms and conditions of use. Do not use MapCenter2 if you do not agree with any of these Terms. MapCenter2 authors provide the service and all Maps to the User, conditioned upon the acceptance, without modification, of the Terms contained herein.

We reserve the right to change, modify, add or remove portions of these Terms at any time. Such modifications will take effect immediately after posting to MapCenter2. If you continue to use MapCenter2 then, it means that you accept the changes.

2. NO UNLAFWUL OR PROHIBITED USE

By using MapCenter2 you guarantee that you will not use MapCenter2 or any content obtained from MapCenter2 for any purpose that is illegal or prohibited by these Terms. If you violate any of these Terms, your permission to use the MapCenter2 will automatically terminate.

3. Description of MapCenter2 web service

MapCenter2 web service is a website owned by GPS enthusiasts, with the purpose of creating and sharing maps compatible with Garmin GPS receivers. We are offering space on our website for sharing maps with all Users.

MapCenter2 currently offers free access to an advanced version of cgpsmapper program and allows to convert Polish Format data to binary Map format. MapCenter2 does not provide any support on using the cgpsmapper program - this program is provided “as is”.

The author of cgpsmapper program does not provide any support to Users on using the program.

All content uploaded to the service automatically becomes available to all Users. It includes all data available in Polish Format and all Maps in binary format which were created using the cgpsmapper program.

MapCenter2's goal is to offer all Users a rich collection of Maps at no charge. Users may download, use, and modify Maps for free at least for personal and educational purposes. Authors may decide whether content of their uploads can be freely used and/or freely modified and distributed for purposes other than private. Authors agree that any content uploaded to MapCenter2 may be released under the UMP license.

Please note, that uploading new or modified Maps to MapCenter2 for compilation is equivallent to distributing this Map and may be performed only by map's Author or in accordance with Map's license.

4. Registration obligations

Each user must provide true, accurate, current and complete information when filling-in the Author registration form, and maintain and promptly update the registration data if necessary. If, after investigation, there would be reasonable grounds to suspect that the User's information is untrue, inaccurate, not current or incomplete, the User's account may be suspended or terminated and the User may be prohibited of any and all current and future use of MapCenter2.

Each Author will receive a password and account designation after completing MapCenter2 registration process and is wholly responsible for maintaining the confidentiality and liable for all activities associated with his account.

5. Maps and other content

All information, whether publicly posted on or privately transmitted via MapCenter2, are the sole responsibility of the person from which such content originated. This means that Authors themselves - not MapCenter2 - are entirely responsible for all content that is uploaded or otherwise transmited to MapCenter2. Noone should transmit content or participate in any activity on MapCenter2 which, according to MapCenter2 staff is likely to be prohibited by law in any applicable jurisdiction, including the permissible uses of intellectual property, copyrighted maps data, data from illegal sources or data obtained from 3rd party sources.

Not all available content will be reviewed. However, MapCenter2 staff reserve the right to block or delete any content reasonably considered to violate the these Terms or be otherwise illegal.

MapCenter2 staff reserve the right to block Author's access to the MapCenter2 if he is suspected of publishing any data in violation of the Terms or being otherwise illegal.

6. Termination

An Author's account may be terminated in absolute discretion and for any reason. Especially, for reasons that include, but are not limited to, the following: 1.) violation of these Terms; 2.) abuse of site resources or attempt to gain unauthorized entry to the site or site resources; 3.) use of MapCenter2 in a manner inconsistent with the Terms; 4.) User's request for such termination; and 5.) requirement of applicable law or regulation.

Termination of any User's access to MapCenter2 may be effected without notice. On such termination, User's account may be immediately deactivated or deleted and/or further access to such files may be banned.

7. Disclaimer of warranties

EACH USER USES MAPCENTER2 AT HIS OWN RISK. MAPCENTER2 SERVICES ARE PROVIDED “AS IS” AND ON “AS AVAILABLE” BASIS. MAPCENTER2 OWNERS ASSUME NO RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY OR FAILURE TO STORE ANY DATA.

EACH USER AND AUTHOR WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO HIS OR HER COMPUTER SYSTEM OR LOSS OF DATA. MAPCENTER2 IS NOT RESPONSIBLE FOR QUALITY AND CORRECTNESS OF ANY AVAILABLE DATA IN THE SERVICE. MOREOVER EACH MAPCENTER2 USER IS SOLELY RESPONSIBLE FOR ANY DAMAGE TO HIS OR HER GPS RECEIVERS POSSIBLY CAUSED BY ANY DATA DOWNLOADED FROM MAPCENTER2. MAPCENTER2 CANNOT GIVE ANY GUARANTEE IN REGARD TO DATA COMPLETENESS, CORRECTNESS OR CURRENCY. MAPCENTER2 DOES NOT ACCEPT LIABILITY IN THE EVENT OF DIRECT OR INDIRECT CONSEQUENTIAL OR COLLATERAL DAMAGE RESULTING FROM THE USE, INCORRECT USE OR MISUSE OF THE MAPS.

MAPCENTER2 STAFF AND CGPSMAPPER AUTHOR DO NOT PROVIDE ANY SUPPORT FOR USING THE CGPSMAPPER PROGRAM AVAILABLE IN MAPCENTER2 SERVICE.
